Appointment of a Receiver and Supervisory Role of the Court
The appointment of a receiver is a discretionary order made by the Court pursuant to the provisions of s. 101 of the Courts of Justice Act, R.S.O. 1990, c. C.43, Rule 41.02 of the Rules of Civil Procedure, R.R.O. 1990, Reg. 194, and Rule 20 of the Family Law Rules. A Receivership Order operates as an exception to the general principle that the Court will not generally grant execution before judgment.
